Terms of Service
These terms are an agreement between Lusus ("Lusus", "we", "us") and the business that installs the Lusus app on its Shopify store ("you"). By installing or using Lusus you accept them. If you accept them for a business, you confirm that you're allowed to do so.
1. The service
Lusus is a Shopify app for discounts with rules, unique discount codes and prize games (such as a spin-to-win wheel and a slot machine) that you show on your store. Players can become customers of your store, with the marketing consent they choose to give. What each plan includes is shown in the app and on our Shopify App Store listing.
Lusus works inside Shopify, so you also need a Shopify store in good standing and you must follow Shopify's terms.
2. Plans, trials and billing
- Lusus has a free plan and paid plans. Paid plans are billed by Shopify, in US dollars, monthly or yearly, together with your Shopify bill, plus any taxes that apply.
- Paid plans may start with a free trial. If you keep the plan after the trial, Shopify charges you for it.
- You can change or cancel your plan at any time from the app. Changes and refunds follow Shopify's billing rules; we may give refunds or credits at our discretion.
- Plans have monthly allowances (for example, plays and unique codes). When you reach one, the related feature pauses until your allowance starts over on the first day of the next month (UTC) or until you change plan.
- We may change prices or plans. Shopify will notify you before a price change applies to you.
3. Your responsibilities
- Your promotions: you decide the prizes, discounts, chances and rules, and you're responsible for honoring them and for describing them clearly to your shoppers.
- Laws about promotions: prize games, sweepstakes and contests are regulated in many places. You're responsible for making sure your games and their terms comply with the laws where you sell, including any registration, odds disclosure or "no purchase necessary" rules.
- Marketing consent: you're responsible for how you use shoppers' contact details and for following email marketing and anti-spam laws. Lusus only marks a shopper as subscribed when they tick the consent box themselves.
- Your privacy notice: you must tell your shoppers how you use their data, including through apps such as Lusus, and answer their requests. Lusus gives you tools for that in its Privacy page.
- Your content: the texts and prizes you add must be accurate and lawful and must not infringe anyone's rights.
4. Acceptable use
You agree not to use Lusus to mislead shoppers or break the law; not to try to get around plan limits or security; not to copy, resell, reverse engineer or overload the app; and not to access other stores' data.
5. Data and privacy
Our Privacy Policy explains how Lusus handles data. For shopper data, you're the controller and Lusus processes it on your behalf, only to provide the service and according to your instructions given through the app. Lusus answers Shopify's privacy requests about your store and deletes your store's data after you uninstall the app, as described in the Privacy Policy.
6. Intellectual property
Lusus and everything we provide with it belong to us. While you use Lusus, we give you a limited, non-exclusive, non-transferable right to use it for your store. Your content and your store's data remain yours; you allow us to use them only to provide and improve the service for you. If you send us suggestions, we may use them freely.
7. Availability and changes
We work to keep Lusus running and secure, but we can't promise it will always be available or free of errors. We may improve, change or remove features. If we remove a feature that is central to a paid plan you're on, we'll tell you in advance.
8. No warranties
Lusus is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee any result in sales or customers.
9. Limitation of liability
To the extent the law allows, Lusus isn't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim related to Lusus is limited to the amount you paid us for the app in the 12 months before the claim, or USD 100 if you paid nothing.
10. Indemnity
You'll defend and hold Lusus harmless from claims arising from your promotions, your content, your use of shoppers' data or your breach of these terms or of the law.
11. Ending the service
You can stop using Lusus at any time by uninstalling it. We may suspend or end your access if you seriously or repeatedly break these terms, if the law or Shopify requires it, or if we stop offering Lusus (in that case we'll give you reasonable notice). After uninstalling, your store's data is deleted as described in the Privacy Policy.
12. Governing law
These terms are governed by the laws of Colombia. Disputes will be handled by the competent courts of Colombia, unless the law of your country gives you a right to go to your local courts.
13. Changes to these terms
We may update these terms. We'll publish changes on this page with a new date and tell you in the app or by email before an important change applies. If you keep using Lusus after that, you accept the new terms.
